It’s copyrighted and their terms of service state that you can’t use it outside of the program, but copyrighted music is used in quite a few romhacks and nobody complains. The music was originally stored as MIDIs, so the VGMusic rule doesn’t apply here. I’m honestly not sure if FEU cares or not, which is why I’m asking here.

The copyrighted music in romhacks falls under fair use due to the fact they’re technically covers.
Also, romhacks are grey legality anyway.
But since you’re using the actual original files and the terms of service explicitly forbid it, you’d have a hard time justifying use in romhacks. A remix might pan out, though, as long as you manually transcribed the notes instead of using the original MIDI.
